Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you and Njofa Group Inc., a corporation incorporated under the laws of Canada and the publisher of the Fanbula mobile application.

These Terms contain a binding arbitration agreement and a class-action waiver (Sections 13 and 14). Please read them carefully.

You must be at least 18 years old to use the Service. No exceptions, no parental-consent pathway. The Service is offered to users in the United States and Canada.

Create an account with accurate information. Safeguard your credentials. Notify support@fanbula.app of unauthorized access. No account sharing, no bot accounts, no impersonation.

Prohibited (non-exhaustive): hate speech and slurs, doxxing, pirated streams, automated/bot interactions, spam, harassment/bullying/stalking, sexual content involving minors, threats/incitement to violence, impersonation, attempts to compromise the Service.

You retain ownership of your content. You grant Njofa Group Inc. a worldwide, non-exclusive, royalty-free, sub-licensable license to host, display, and distribute your content within the Service.

You represent that you own all necessary rights to the content you submit and that it does not infringe any third-party rights.

Fanbula is a NEUTRAL VENUE, not a party to any gathering. We do NOT vet, screen, or background-check hosts or attendees.

By participating in a gathering, you assume all risks including personal injury, illness, theft, harassment, assault, alcohol-related risks, traffic accidents, and others both foreseeable and unforeseeable.

To the maximum extent permitted by applicable law, you release Njofa Group Inc. from any and all claims arising out of any gathering.

We may suspend or terminate access for violations of these Terms. Appeals: write to appeals@fanbula.app within 30 days. Substantive response within 14 days where reasonably practicable.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim all warranties to the maximum extent permitted by applicable law.

To the maximum extent permitted by applicable law, our total cumulative liability will not exceed the greater of $100 USD or the fees you paid us in the 12 months prior. The Service is currently free, so the effective cap is $100 USD.

You agree to defend and indemnify Njofa Group Inc. against claims arising from your content, your conduct on the Service, your participation in any gathering, and your violation of these Terms or any third-party right.

Governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes not subject to arbitration go to the Ontario Superior Court of Justice (Toronto).

Binding arbitration administered by the ADR Institute of Canada (ADRIC). Seat: Toronto, Ontario. Governed by the Arbitration Act, 1991 (Ontario).

30-day opt-out: write to optout@fanbula.app within 30 days of accepting these Terms.

Disputes will be resolved on an individual basis only, not as a class. Quebec residents: under Quebec's Consumer Protection Act and Code of Civil Procedure, your statutory right to bring or participate in a class action may not be waived by contract; to the extent unenforceable, your statutory rights remain intact.

If you obtained the Service from the Apple App Store, Apple's required boilerplate applies: Apple is not responsible for the Service, has no maintenance obligation, and is a third-party beneficiary of these Terms. See the full text in the in-app Terms of Service.

If you obtained the Service from Google Play, Google's required boilerplate applies: Google is not responsible for the Service and is a third-party beneficiary of these Terms.

Compliance with Canadian sanctions laws (Special Economic Measures Act, Magnitsky Law, Export and Import Permits Act, etc.) and applicable U.S. export controls is required.

We may revise these Terms. Material changes get at least 30 days' advance notice via in-app banner, push, or email.
